Birth Leave

- a. A Teacher may
request a leave of absence for the birth of a child beginning
at a time to be determined by the Teacher and her doctor. In
the event of a loss of child during birth leave, the Teacher
may return immediately to a teaching position, provided the doctor
certifies that she is in sound health, and an appropriate vacancy
exists. If there is no vacancy, the Teacher shall be given preferential
status as soon as such vacancy exists.

- b. Following the
birth of the child, the Teacher may return to a teaching position
at the opening of the next school year, provided her doctor supplies
a written release stating that, in his/her judgment, she is physically
and emotionally able to resume her classroom duties.

- c. Insofar as possible,
leave shall begin at a time which is consistent with the orderly
continuance of the educational program. The personnel office
should be notified regarding the Teacher's plans as far in advance
as possible to enable the District to make arrangements for an
adequate replacement.

- d. Birth leave shall
consist of the following options:
| i. Unpaid leave
of absence for the remainder of the school year if the leave
begins prior to November 1st. |
| ii.
Unpaid
leave of absence for the remainder of the school year plus one
additional school year if the leave begins after November 1st. |
| iii. Short-term leave
of absence for a period of up to twelve (12) weeks per year for
birth leave or to care for a child under the age of one year.
Teachers may use sick leave for the temporary incapacity period
during which they are disabled while on short-term birth leave.
If the leave exceeds the temporary incapacity period, the remainder
of the leave will be unpaid. If the child or Teacher becomes
ill during the unpaid portion of the leave, sick days may be
used. The Teacher shall notify the personnel office of sick days
as they occur. This leave is considered as one of the options
under Family/Medical Leave. |
