ARTICLE
1 - DUTIES OF OFFICERS
Section 1: President - The President shall be
the official spokesperson for the Association and be responsible
for all communications between the Association, the Board of
Education, and the membership. The President shall meet with
district administrators and attend Board of Education meetings
on a regular basis. The President shall approve all correspondence
written in the name of the Association and sign, with the Recording
Secretary, contracts and other instruments in writing which have
been authorized by the Association Representatives or the Association.
The President shall preside at all meetings of the Association,
the Representative Assembly, and the Executive Board. The President
shall serve as an Association Representative on the IEA Region
Council and as a delegate to the IEA and NEA Representative Assemblies.
The President shall be granted release time, which shall not
exceed half-time time, for the purpose of transacting Association
business. The President may allocate released time for the Executive
Director. The President shall appoint yearly, with the approval
of the Association Representatives, all committee chairs not
otherwise provided for and be ex-officio member of all committees
except the Nominations Committee.
Section 2: Executive
Director - He/she
shall succeed to the Presidency if the President is unable to
perform his/her duties or resigns. He/she shall fulfill any responsibilities
deemed appropriate by the President and Executive Board. The
Executive Director shall be granted release time, which shall
not exceed half-time, for the purpose of transacting Association
business.
Section 3: 1st Vice-President - He/she shall assume the
duties of the Executive Director in his/her absence. He/she shall
be an ex-officio member of all committees except the Nomination
Committee. He/she shall assist the 2nd Vice President in planning
the program for the Council. He/she shall assume any duties the
President or Executive Board may require.
Section 4: 2nd Vice-President
- He/she shall
be an ex-officio member of all committees, except the Nomination
Committee. He/she shall be the program planner of the Council.
He/she shall act as Parliamentarian at all meetings. He/she shall
assume any duties the President or Executive Board may require.
Section 5: Recording
Secretary -
He/she shall take minutes of all Executive Board, General Council,
and Building Representatives Assembly meetings. He/she shall
notify the Executive Board, Building Representatives, and the
membership of the Council of upcoming meetings. He/she shall
assume any duties that the President or Executive Board may require.
In June, he/she shall place copies of all assembly minutes, newsletters
and newspaper articles regarding CTC activities in the "Past
Years" file.
Section 6: Corresponding
Secretary -
He/she shall maintain communication with the IEA, NEA, CTC members,
and other local education associations. He/she shall assume any
duties that the President or Executive Board may require.
Section 7: Treasurer
- The Treasurer
shall be responsible for the collection of all dues. He/she shall
have charge of all funds of the Council, in the bank designated
by the Executive Board, and shall disburse them as authorized
by the Executive Board or the Council. He/she shall be required
to give an itemized account of finances at each Council meeting.
He/she shall be required to give an itemized listing of the finances
of the Council to the membership, in writing, at the beginning
and end of each school year. He/she shall assume any duties that
the President or Executive Board may require.
Section 8: Transferring
Documents -
Each officer shall deliver to his successor, on or June 30, all
records, accounts, books, papers, and other property belonging
to the Council.
ARTICLE
II - DUUTIES OF THE EXECUTIVE BOARD
Section 1: Upon the Executive Board
shall rest the duties and responsibilities for the conduct of
the Council in all matters. It shall be empowered to act for
the Council in matters of emergency.
Section 2: The Executive Board, by
a two-thirds' vote, shall be empowered to make appropriation,
provided, however, that the appropriation of any sum exceeding
$100 must also be approved by the Building Representatives Assembly.
Section 3: The Executive Board shall
select place(s) of deposit for the funds of the Council. The
bank designated may be an interest-bearing account, except for
the IPACE account, which may not be an interest-bearing account.
Section 4: The Executive Board shall
be responsible for overseeing the audit of the Treasurer's books,
which shall be closed prior to
September 1.
Section 5: The Executive Board shall
be responsible for the training of Building Representatives concerning
terms of the contract, grievance procedures, and other matters
as needed.
Section 6: Each year, the Executive
Board shall assign an officer as an ad hoc member of each standing
committee.
Section 7: The Executive Board will
make a written report at the end of the school year to the Building
Representatives Assembly concerning the services provided by
IEA to the CTC for that year. It will be the duty of the Executive
Board to relay any recommendations by the Assembly to the Regional
Representatives of the IEA.
Section 8: Signature Authorization
- The members of the Executive Board shall be authorized to sign
all vouchers, contracts, and other written instruments authorized
by the Executive Board, Building Representatives Assembly, or
Council. The Treasurer and two other Executive Board members
must sign any document requiring the expenditure of the Council's
funds after approval by the Building Representatives Assembly.
Any two of the Executive Board may sign a document not requiring
an expenditure of funds.
ARTICLE
III - DUTIES OF THE BUILDING REPRESENTATIVE
Section 1: It shall be the duty of
the Building Representatives to meet and discuss the issues concerning
the Council. Each member is free to voice a personal opinion;
however, each Representative should strive to put forth the consensus
views of his/her Building.
Section 2: The Building Representative
shall inform the faculty of his/her Building of action taken
by the Executive Board, Building Representatives Assembly, and
general membership.
Section 3: The Building Representative
shall keep a file of contracts Constitution, Building membership
names and addresses, and retirement and grievance information.
He/she shall conduct elections and surveys in his/her Building;
may serve on one committee; represent CTC/IEA in dealing with
the principal; distribute newsletters and other materials; maintain
an accurate e-mail distribution group; be a watchdog for contract
violations; be a policy developer and maker; and know the master
contract so he/she can advise teachers of their rights and responsibilities.
Section 4: The Building Representatives
Assembly shall have the power to remove from office any Executive
Board member or Building Representative or Alternate for reasons
deemed advisable by the Assembly. Such action shall require a
two-thirds' majority vote of the Building Representatives Assembly.
ARTICLE
IV - DUTIES OF MEMBERS
Section 1: It shall be the duty of
all members to attend general meetings, vote in CTC/IEA/NEA elections,
complete and return organization questionnaires, and attend sanctioned
CTC building meetings.
Section 2: Members are encouraged
to support teacher organizations in their local school board
elections.
Section 3: Members are encouraged
to support the Association's legislative issues by contacting
their local senators and representatives at both the state and
federal levels of government. The contact may be in person, by
letter, email, or phone.

V - STANDING COMMITTEES
Section 1: The standing committees
shall be: Salary and Professional Negotiations, Membership, Public
Relations, Teacher Relations, Legislative-IPACE, Grievance, and
Elections and Nominations. Chairs of each standing committee
shall be appointed by the Executive Board, subject to approval
by the Association Representatives. Each committee chair shall
appoint committee members subject to approval by the Association
Representatives.
Section 2: Each committee chair shall
be responsible for reporting to the Executive Board and the Association
Representatives
Section 3: The President may appoint
such special, temporary ad hoc committees as he/she and/or the
Executive Board may deem expedient.
Section 4: The President may remove
any committee member with the approval of the Executive Board.
ARTICLE
VI - DUTIES OF THE STANDING COMMITTEES
Section 1: Professional Negotiations- It shall be the duty of the Professional
Negotiations Committee to represent the Council in good faith
in negotiations with the Board of Education of CCSD #15. The
Committee shall serve from its formation until the members have
accepted a contract settlement.
Section 2: Membership - It shall be the duty
of the Membership Committee to ascertain membership, transmit
updated membership information to IEA-NEA, and to help promote
membership in the Council.
Section 3: Public
Relations -
It shall be the duty of the Public Relations Committee to broadcast
the interests of the Council through every possible channel,
and to broaden the Council's public contacts.
Section 4: Teacher
Relations -
It shall be the duty to of the Teacher Relations Committee to
inform the membership of action taken by the Executive Board,
Building Representatives Assembly, the Council membership standing
or temporary committees through the use of a regularly issued
newsletter or some other similar device. It shall strive to promote
positive interaction between teachers and the Council, and to
promote fellowship among members through various activities.
Section 5: Legislative-IPACE - It shall be the duty
of the Legislative IPACE Committee to make the membership aware
of local, state, and national legislative efforts that affect
education and to support such actions favored by the Council.
It shall be the duty of this committee to bring to the Council
background information concerning candidates for public office.
Section 6: Grievance - It shall be the duty
of the Grievance Committee to advise all prospective grievants
of their rights and obligations. It will also present to the
Executive Board its findings as to whether or not a grievance
is capable of being won in arbitration. The Committee will report
at least once a month to the Building Representatives Assembly
the status of each and every grievance in progress.
Section 7: Elections
and Nominations -
It shall be the duty of the Elections and Nominations Committee
to be responsible for all balloting of the Association. This
Committee shall be responsible for conducting the elections of
the delegates to the IEA and NEA Representative Assemblies in
accordance with the IEA and NEA Bylaws and the Region Elections
Calendar. This Committee shall be responsible for conducting
other elections as directed by the Executive Board.
ARTICLE
VII - DELEGATES FOR IEA/NEA REPRENTATIVE ASSEMBLIES
Section 1: Delegates for the IEA or
NEA Representative Assembly must be members of CTC/IEA/NEA in
good standing.
Section 2: Delegates should be members
who have served the Council in its activities.
Section 3: Delegates and alternates
will be elected by the membership at large to IEA and NEA Representative
Assemblies.
Section 4: Delegates shall report
the major issues at a Building Representative meeting, prior
to the Representative Assembly. They shall also report on the
proceedings of the RA to the Building Representative Assembly
at the earliest possible date.
Section 5: Delegates shall represent
the stated interest of the Building Representative Assembly.
ARTICLE
VIII - NOMINATIONS
Section 1: The Nominations and Elections
Committee Chair shall appoint three or more Association members
to the Committee. This Committee shall be responsible for all
balloting of the Association. No person on the Committee who
is a candidate shall be involved in any manner in the operational
procedure of the election for which they are seeking office.
This Committee shall be responsible for conducting the elections
of the Representatives and Delegates to the IEA and NEA Representative
Assemblies in accordance with the IEA and NEA Bylaws. This Committee
shall be responsible for
conducting other elections as directed by the Executive Board.
The Nominations
Committee may use electronic communication to notify members
of upcoming elections. This shall include e-mail and fax methods
of communication. In addition to the electronic notification,
a print nomination form shall be posted on the Association bulletin
board in each building.
Members may use
the same electronic means of communication to nominate themselves
or another member. Members may also use a printed nomination
form, copied from the Association bulletin board. The Elections
Chair shall confirm receipt of the nomination.
Section 2: Nominations of Officers
-This Committee shall contact the possible candidates for their
consent before placing their names in nomination. This Committee
shall prepare a list of those candidates to be sent to each school
before the General Association meeting in April or May.
At the general Association
meeting in April or May the Chair shall present the candidates.
Nominations will also be accepted from the floor provided that
the consent of the nominee has been obtained. Nominations shall
close at the conclusion of the Chair's report.
When the number
of candidates equals the number of positions available, candidates
may be declared elected provided that no write-in votes are permitted.
Results of the election
must be published in a timely manner, which allows members to
obtain the information without unusual effort.
Section 3: All elections
must follow the rules and guidelines described in the IEA-NEA
elections handbook as required by the Landrum-Griffin Act.
ELECTIONS
ARTICLE
IX - ELECTION OF OFFICERS
Section 1: The Executive Board must
set the date for the annual elections. The elections shall be
conducted by secret ballot in the schools.
Section 2: Completed ballots shall
be delivered to the Building Representative(s), who in turn will
return them to the Elections and Nominations Committee. The committee
will then supervise the counting of the ballots and upon completion
of the count, the Elections and Nominations Committee Chair shall
notify each candidate by telephone of the election results. The
Nominations Committee shall also report the election results
by numerical tally to each school by written notice within three
school days. The results shall be posted in each building.
Section 3: Members shall vote in their
home-based buildings. Itinerant members may vote in the building
they are working in on election day. The Nominations Committee
shall verify that the itinerant member only voted once. Absentee
ballots are not allowed.
Section 4: All candidates elected
to office shall assume their duties on July 1, following the
election.
Section 5: A majority of all votes
cast in the election for each office shall be necessary for election
to that office. In the event that no candidate receives a simple
majority, a run-off election shall be held as soon as possible
between the two candidates who received the greatest number of
votes.
Section 6: Vacancies on the Executive
Board may be filled by a majority vote of the remaining members
except as mentioned in Article IX, Section 7.
Section 7: If three or more offices
of the Executive Board are vacant at the same time, a special
election must be held to fill those offices within thirty days
of that occurrence. In the interim, the Building Representatives
Assembly may conduct business and the Assembly may select temporary
officers to fill the vacancies.
Section 8: All officers shall serve
a two-year term of office. The President, 1st Vice-President,
and Recording Secretary shall be elected in odd-numbered years.
The Executive Director, 2nd Vice- President, Corresponding Secretary,
and Treasure shall be elected in even- numbered years.
ARTICLE
X - ELECTION OF REGIONAL COUNCIL MEMBERS
Section 1: Representatives to the
Region Council shall be elected for a two-year term.
Section 2: Elections to the Region
Council shall be by the membership at large in accordance with
the IEA/NEA Bylaws and the Regional Elections Calendar.
Section 3: Members shall vote in their
home-based buildings. Itinerant members may vote in the building
they are working in on election day. The Elections Committee
shall verify that the itinerant member only voted once. Absentee
ballots are not allowed.
ARTICLE
XI - DUTIES OF REGIONAL COUNCIL MEMBERS
Section 1: Members shall attend all
meetings called by the Region Council.
Section 2: Members shall serve as
non-voting members of the Building Representatives Assembly unless
otherwise elected.
Section 3: A report of Region Council
activities shall be given monthly to the Building Representatives
Assembly.
ARTICLE
XII - ELECTION OF BUILDING REPRESENTATIVES
Section 1: The Executive Board must
set the date for the annual election of Building Representatives
on or before the last day of the first full week of school each
year. The elections shall be conducted by secret ballot in the
schools, and the President will be notified of the results.
Section 2: Each Building Representative
shall deliver to his/her successor all records, accounts, books,
papers, and other property belonging to the Council.
Section 3: The term of office for
Building Representatives will be one year.
ARTICLE
XIII - MEETINGS
Section 1: The President or Executive
Board shall call for Building Representative and General meetings
of the Council.
Section 2: The Executive Board shall
have the power to postpone a scheduled meeting provided Article
XIII, Section 4, is not violated.
Section 3: The Executive Board shall
hold a meeting within ten days prior to a general meeting. It
will also meet at the request of the President or of three members
of the Executive Board at least once a month.
Section 4: The Building Representatives
Assembly shall meet at the call of the President or of three
members of the Executive Board at least once a month during the
school year.
Section 5: The meetings of the Council,
Executive Board, and Building Representatives Assembly shall
be conducted according to the rules of parliamentary procedure
comprised in Robert's Rules of Order, Newly Revised.
ARTICLE
XIV - DUES AND FUNDS
Section 1: The dues of the Council
shall be the total of the NEA and IEA regular dues plus the local
dues. Local dues are to be determined by the Executive Board
with the consent of the Building Representatives Assembly.
Section 2: The funds acquired from
dues shall be used to pay the obligations of the Council.
Section 3: The fiscal year shall begin
on September 1 and end August 31 of any given year.
Section 4: Dues shall be paid by payroll
deduction (20 payments for a typical year). If a member chooses
to pay dues by cash, the total dues amount must be received by
the treasurer before the date when payroll deduction for dues
commences. If cash payment is not received before that date,
the member will be automatically changed to payroll deduction
for dues collection (19 payments for a typical year).
Section 5: At the beginning of each
fiscal year, at least half of the funds shall be deposited in
an interest-bearing bank account to be determined by the Executive
Board. IPACE funds may not be deposited in an interest-bearing
account.
ARTICLE
XV - RATIFICATION OF CONSTITUTION
This Constitution
and Bylaws with its revisions shall be in effect immediately
upon ratification by a two-thirds' majority of those voting.
ARTICLE
XVI - RATIFICATION OF CONTRACT
Section 1: Only current members of
the Council shall be eligible to vote on acceptance of a new
contract.
Section 2: A contract shall be ratified
by 2/3's of the membership voting.
Section 3: The Executive Board shall
supervise the counting of the ballots.
